Environmental Practice Area

Environmental problems can arise in many ways including by operation of an industrial or commercial facility, transportation of materials, spills, historic or current disposition of waste and during real estate transactions, to name a few. The environmental laws have over the years expanded in their scope and reach to impose liability on individuals and entities not considered to be direct polluters of the environment, often imposing significant financial burdens on those liable under the law. The environmental laws and regulations that impact on these entities and activities are numerous and complicated. We at Tressler, Soderstrom, Maloney & Priess, LLP counsel clients regarding day-to-day business activities and defend them if they find themselves in litigation.

We have experience with, and have litigated cases under, numerous federal and state environmental statutes including the Comprehensive Environmental Response, Compensation and Liability Act ("CERCLA"), the Resource Conservation and Recovery Act ("RCRA"), The Clean Water Act, the Clean Air Act, the Toxics Substances Control Act, The Occupational Safety and Health Act ("OSHA"), the Illinois Environmental Protection Act and state environmental statutes in Indiana, Michigan, Missouri and Florida. We have experience in the public sector at the Illinois Attorney General's Office, and have obtained valuable insights regarding the types of cases prosecuted by government agencies. Our work has involved evaluating the technical issues presented in a case and partnering with experts in various fields, including material analysis, hydrogeology and remediation techniques. These types of problems also can include toxic tort claims.

Our goals in these environmental cases are to define the problems presented to the client and develop common sense, cost efficient solutions to those problems.
