We prosecute and defend all types of contract, lien, bond, tort and insurance claims for and against owners, developers, architects, engineers, contractors, subcontractors and suppliers. We help our clients efficiently resolve bid disputes, extra work and change order claims, completion issues, construction lending issues and disputes, contract compliance issues, quality of work issues, design defect issues, delay issues, differing site condition claims, mechanic's liens, liens against public funds, performance and payment bond claims and insurance coverage claims.

Surety

Tressler, Soderstrom, Maloney & Priess, LLP's Fidelity and Surety Group is proficient and experienced in public and private construction project default analysis, negotiation of financing and takeover agreements, and performance and payment bond claim handling and litigation. This includes issues concerning differing site conditions, extra work, completion, defective work, defective design, delay, interference, acceleration and surety defenses. The Group is proficient and experienced in indemnity and salvage, priority disputes, and bankruptcy relief. We also have extensive experience in handling miscellaneous surety bond claims, including public official bonds, probate, ERISA and other fiduciary bonds, and judicial bonds.

Real Estate

Tressler, Soderstrom, Maloney & Priess, LLP's Real Estate Group represents owners, developers, investors and lenders in commercial, residential and industrial real estate projects. We are regularly called upon to represent owners and developers in the acquisition, development and construction of commercial retail and office projects as well as single and multi-family subdivision/PUD developments. We advise clients in the structure and formation of ownership entities whether they are joint ventures, limited partnerships, limited liability companies or other types of ownership entities. Once the projects are completed, our attorneys are skilled advisors to ownership in the leasing, operation, financing and sale of these properties.

Construction Defect

The construction defect team counsels insurance and corporate clients with respect to personal injury, defect and property damage claims. The team has represented a variety of contractors, subcontractors, architects and engineers. Tressler, Soderstrom, Maloney & Priess, LLP also advises clients with regard to indemnity and additional insured analysis. Claims of personal injury and property damage caused by "toxic mold" are also handled by the construction defect team. Claims of inhalation and exposure to "toxic mold" are becoming more frequent and the construction defect team recognizes the importance of these issues.
